Rules for Participation in the Auction

Name of the Organizer

The auction is organized by PAVOT, hereinafter referred to as the 'Organizer' or 'Auction House', and will take place at the location on Andrei Mureșan Street 18, Sector 1, Bucharest, under the direction of the Organizer's representative.

Subject of the Auction

The exhibition includes all the works of visual art displayed in the catalog and/or in the exhibition space, each identified by the serial number indicated next to each one.

The works of art subject to the auction are in the custody of the Organizer, based on custody contracts, and belong to institutions, collectors, living contemporary artists, or individuals who have the right to distribute (transfer) them, hereinafter referred to briefly as 'consignors' or 'depositors'.

In the event that consignors wish for their identity to remain undisclosed, this mention will be indicated next to the exhibit.

Interested individuals are invited to inspect the exhibition during the Preview event or on any other day prior to the auction session, in order to carefully examine the works of visual art, inspect their condition and content, and form a clear and unbiased opinion. Filming or photography is permitted only with the Organizer's consent.

All items are sold in the condition they are in at the time of sale, "as it is."

The Organizer's representatives provide assistance, clarifications, and technical details about the exhibited visual art pieces to interested visitors.

Visitors are required to pay extra attention when moving through the exhibition space

Handling of artworks is strictly prohibited. Any damage caused to the exhibits will be borne by the liable party, who, whether intentionally or through negligence/even slight fault, caused the damage. In such cases, the compensation for the damaged exhibit will amount to its maximum estimated value for sale through public auction.

Organizing and Conducting the Auction Session

The Organizer publishes, prior to the auction, a catalog of the artworks to be auctioned on their website, www.pavot.art, along with an announcement regarding the date and time of the auction session. Until the date of the auction session, the exhibition can be visited by any interested party.

The auction session may be video recorded and streamed live on the website www.pavot.art or other communication channels, including social media platforms. Participants attending the auction session in person will be required to express their consent or objection for this purpose before the session begins.

The auction will proceed in the order listed in the catalog and will conclude once the last item in the catalog has been auctioned.

Conditions for Participation in the Auction

Any natural or legal person, either in their own name or representing another individual, may participate in the auction.

Persons directly interested or their authorized representatives may participate in the auction, provided they present proof of the mandate entrusted to them.

In order to participate in the auction, it is necessary to fully and truthfully complete the registration form found on the Organizer's website, providing the following information: full name, date of birth, phone number, email address, and details regarding the capacity in which the person is participating (either for personal interest or as an agent acting on behalf of a third party).

After the registration form for the auction is validated, interested individuals will be contacted by email by the Organizer's representatives in order to provide a copy of their identity document and, if applicable, the mandate granted by the person on whose behalf they are acting.

Interested individuals who are unable to attend the auction session in person or through a representative may participate in absentia, by completing the auction participation form as follows:

By submitting a written bid in which the artworks of interest and the maximum bidding values are specified.

The written bid will be based on the minimum starting price of each painting for which the participant wishes to place a bid.

In the event that no other person places a bid on an item included in the written offer, or if the last bid is below the maximum value specified in the offer, the item will be awarded to the person who submitted the written offer. The final price will be the last bid amount, plus the bid increment and the total auction fee.

By participating via telephone through the Auction House staff.

For this purpose, interested individuals are requested to contact the Organizer to arrange the method of participation in the auction at least 2 days prior to the auction session date.

Upon registration of the registration form, the participant will be assigned a bidding paddle, which will include the assigned bidder number.

By registering for the auction, the participant expresses their unconditional acceptance of the terms and conditions of this Regulation, acknowledged by their handwritten signature.

Rules of Auction

The price listed in the catalog of visual art offers is the minimum sale price, which also represents the starting price of the auction. The catalog may also include the estimated price, which indicates the potential selling value.

At the beginning of the auction session, the exchange rate of Euro/RON used by the Organizer will be established and communicated, which will be the exchange rate applied for the payments

The auctioneer announces the starting price for each item and the corresponding bidding increment. The auction proceeds in the order listed in the catalog, without breaks and without a time limit.

The auction is strictly ascending, with the confirmation of the proposed price being made by raising the bidding paddle in response to the auctioneer's call for the bidding increment.

The bidding increment usually increases by 10%-50% compared to the previous increment, depending on the amount at which the auction starts.

The auctioneer may accept a different amount called out by a bidder, higher than the previous accepted increment, if it is followed by the bidder raising their bidding paddle.

When multiple participants in the auction room raise their paddles simultaneously to bid the price called by the auctioneer, the auctioneer will select one paddle from the bidders, usually choosing in the order the paddles were raised (also considering the visibility of the intent to bid).

The item is awarded to the participant who offers the highest price. The auctioneer will call "sold" and strike the auction hammer. The highest offer constitutes an irrevocable offer to purchase under the conditions and terms of this regulation.

No item will be sold for less than the starting price, either during or after the auction. Items that have not been sold when initially called may be re-offered for sale during the auction if a participant expressly requests it.

The hammer price will be subject to an additional total auction fee. The total auction fee is 26% of the hammer price and does not include VAT (currently, we are not VAT registered), as well as any other taxes associated with the transaction in Romania. In the case of visual art, according to the law, a separate artist’s stamp duty of 0.5% will also be added.

The calling and awarding of the price are made in EUR, which will be used as the currency for calculating the starting price and the final hammer price.

After the auction session is concluded, sales contracts will be executed between the Organizer and the successful bidders.

Payment must be made within 5 days from the date of the auction session, based on the invoice sent by the Organizer via email.

The awarded artwork will be paid by the buyer in RON by Romanian residents or in EUR/USD by non-residents. Payment is made via bank transfer, using the payment details provided in the invoice.

After making the payment, the successful bidder will send a copy of the payment order to the Organizer at the email address info@pavot.art.

After the auction, the successful bidder will not be able to refuse payment by invoking any defect of the item, and the Organizer will not be obligated to repair or restore any sold item to a usable condition.

The artwork can be collected immediately after the Organizer's account is credited with the invoiced amount.

The successful bidders do not have the right to withdraw from the contract, and the awarded artworks cannot be returned.

In the event that the invoiced amount is not paid within the time frame specified in these Regulations, the Organizer may choose between the following options to repair the damage caused:

  • To request the buyer to pay for the awarded item, the total auction fee, as well as a late payment penalty of 1% per day on the total amount due

  • To retain the awarded item for sale, or the amounts resulting from its sale, as payment for the debt.

  • To terminate the contract, obligating the successful bidder who refuses to pay to pay double the total auction fee.

The transfer of ownership takes place at the moment the possession of the awarded item is transferred from the Organizer to the Buyer or to the transport provider chosen by the Buyer, under the condition that the buyer has made the full payment of the invoiced amount. The pickup and transportation of the awarded artwork are the responsibility and at the risk of the buyer. The buyer must collect the awarded item within 10 days of the payment being received at the exhibition venue.

The Organizer retains the right to publish images and descriptions of the sold artwork for promotional purposes.

Contemporary cultural goods can be exported permanently or temporarily without an export certificate, provided that it is certified to the customs authorities that the items in question are works created by living artists.

The consignors are directly responsible, contractually, to the successful bidder in any situation that leads to the subsequent annulment of the sale, and they must compensate the bidder for any damage caused. Regarding the right to distribute (transfer) the works of visual art, the consignors must provide all documents that grant this right. Additionally, the consignors may present the history of each artwork, if applicable.
